Terms of Service

These terms are the agreement between you and Jehad Abughazaleh, South Africa (“we”, “us”), who runs EditFlag (“the service”). By using the service you agree to them. If you do not agree, please do not use it.

1. The service

EditFlag is a design tool for flags and posters that runs in your web browser. It has a free plan and a paid plan called Pro. What each plan includes is shown on the pricing page.

2. Your account

• You need an account only to buy and use Pro, to keep designs online and to post in the gallery. Everything else in the free plan works without one.
• Use an e-mail address that is yours. We send confirmation codes and notices about your account to it.
• Keep your password and the codes we send you to yourself. You are responsible for what happens under your account.
• An account is for one person. Do not share it or sell access to it.
• You must be at least 13 years old to make an account. If you are under 18 you need the permission of a parent or guardian to buy Pro.

3. Pro plans, prices and payment

• Pro monthly costs $15 a month. It renews automatically every month until you cancel.
• Pro 6 months costs $36, paid every 6 months (the same as $6 a month). It renews automatically every 6 months until you cancel. You can cancel at any time: it then stops renewing and Pro stays until the end of the 6 months you paid for. A 6-month period that has started is not refunded, in whole or in part.
• Pro lifetime costs $79, paid once. It is a permanent purchase: it does not renew and does not run out. “Lifetime” means for as long as the service exists. If we ever have to close the service we will tell account holders at least 90 days before.
• Tax may be added to these prices depending on where you live. The final amount is shown before you pay.
• We may change prices for new purchases. A price change for Pro monthly or Pro 6 months is announced by e-mail at least 30 days before it applies to you.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

4. Refunds

Pro lifetime can be refunded within 30 days of the purchase. After 30 days it is final and is not refunded. Pro monthly and Pro 6 months can be cancelled at any time: they stop renewing, and a period already paid is not refunded, in whole or in part. The full rules and the exceptions are in the Refund Policy, which is part of these terms.

5. Your designs

• What you make with the service is yours. We claim no rights to it, apart from what you allow us in section 9 when you post a design in the gallery.
• When you are not logged in, your designs are stored only in your own browser. We never receive them and cannot restore them.
• With Pro, when you are logged in, the designs you save are also kept online in your account, so that you can open them on your other devices, up to 500 designs and 50 MB. Designs kept online while you had Pro stay there and can still be opened if Pro ends; they can be saved online again once Pro is back. A single design can be up to 8 MB after compression.
• We take care to keep designs safe, but we cannot promise that nothing is ever lost. Export a project file of anything that matters to you.
• When you delete a design it is removed from our servers at once. For 30 days we keep only a note that it was deleted, so that your other devices remove it too.

6. Artwork from other sources

The service can load flags, emblems, icons and fonts from outside libraries such as Wikimedia Commons, Iconify, flag-icons and Google Fonts. Each file has its own licence, and some require you to name the author. National flags and emblems are protected by law in some countries. You are responsible for checking that you may use a file the way you intend to.

7. Fair use

Do not use the service for anything unlawful, do not try to get around the limits of your plan, do not use the online storage for anything other than your designs, do not share or resell accounts or licence keys, and do not disturb or attack the service. We may suspend or close an account that breaks these terms.

8. Suggestions

• The suggestion box is public. Everybody who opens it can read what you write and the name you choose to show.
• Keep it friendly and about EditFlag. No insults, no advertising, no links, and no personal details about yourself or anybody else.
• We may hide or delete any suggestion, and block an account from writing more, without giving a reason.
• You can remove your own suggestions at any time.
• We may use any idea posted there to improve the service, without payment or credit.

9. The gallery and share links

• Designs you post in the gallery are public: anybody can see them, with the title, description, tags and the name you choose to show. A post marked “only people with the link” is not listed, but anybody who has the link can open it.
• Anybody who opens a post can open a copy of the design in the editor, change it for themselves and like or report it. Do not post anything you do not want others to copy.
• Only post designs you have the right to share. By posting you allow us to show the design, its picture and its texts in the gallery, in share links and in the link previews of other websites and apps, for as long as the post is up.
• Not allowed: hate symbols and extremist propaganda; content that harasses, threatens or mocks a person or group; anything illegal; sexual or gory content; other people's trademarks, logos or official emblems passed off as your own or as official; personal details of anybody; advertising, links and spam.
• Posts that three different accounts report are hidden automatically until we have looked at them. We may hide or remove any post, and stop an account from posting, without giving a reason.
• You can remove your own posts at any time, and changing a posted design does not change the post until you post it again.

10. Changes and availability

We work to keep the service running and may add, change or remove features. Parts of the service depend on outside libraries that we do not control and that may be unavailable at times.

11. Closing your account

You can stop using the service at any time. To delete your account, open Account in the designer and choose Delete account; you will be asked for your password. This removes the account at once together with everything kept for it: your designs kept online, your gallery posts, your likes and reports, and your suggestions. It cannot be undone. Cancel Pro monthly or Pro 6 months first so that you are not charged again (the designer asks you to). Records of payments are kept only as long as the law requires. If you cannot log in any more, write to support@editflag.com from the e-mail address of the account.

12. Liability

The service is provided as it is. As far as the law allows, we are not liable for lost designs, lost profit or indirect damage, and our total liability to you is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms takes away rights that the law of your country gives you as a consumer and that cannot be set aside by agreement.

13. Changes to these terms

We may update these terms. The date at the top shows the latest version. If a change matters to account holders we announce it by e-mail before it applies.

14. Law

These terms are governed by the law of South Africa, without taking away the protection that the mandatory consumer law of your own country gives you.
